Utah Uncontested Divorce

When the spouses can come to an agreement as to the terms of a divorce, they qualify for a Utah Uncontested Divorce. The process is much cheaper and faster than a standard contested divorce. It is important for the parties to agree on all term - custody of children, child support, alimony, and property division are the main areas that need to be agreed upon. If there are any terms that are not in agreement, then the court cannot grant an uncontested divorce. This is because the one (or more) unresolved issues make it so that the parties are required to go through the discovery process and other procedural processes, and a trial is required on all disagreed-upon issues, regardless of whether there is one disagreed-upon issue, or many.

If there are any unresolved issues, and the divorce is contested, it generally takes about 6 months on average for parties to finally settle and come to an agreement. Parties who never settle will have to have a trial, which can take a year or more to get a trial date. When considering whether to agree on issues, consider the issues themselves, but don't ignore the financial and emotional costs of going through a taxing divorce.
